On November 2, an Illinois district court vacated the newly restrictive Rule of Public Charge in its entirety. The court determined that DHS (the Department of Homeland Security) does not have the authority to make this rule, that the rule violates the Immigration and Nationality Act, and that it is arbitrary and capricious. Unfortunately, on November 4th, the Seventh Circuit Court issued a “an administrative stay” leaving the Public Charge Rule in place while the Government files an appeal.
